Court Sets December Deadline for Fresh Safety Reports on Hillside Endarasha Academy.
The Hillside Endarasha Academy case has been extended, with the court ordering new safety inspections and setting a deadline for an updated health and safety report. Justice Kizito Magare instructed the Education Cabinet Secretary, Nyeri County Director of Education, Attorney General, and the Nyeri County Education Board to deliver this report by December 20, following delays in their compliance with previous orders.
The court’s requirements come after an October 7 suit filed by the Kenya Human Rights Commission, David Karani, and the Elimu Bora Working Group, who raised concerns over safety standards at Hillside Endarasha Academy. The petitioners, represented by Chimei and Malenya Company Advocates, requested a mandatory inspection to address what they saw as hasty reopening plans, especially after a tragic fire claimed the lives of 21 students. They argue that the respondents have yet to provide a thorough report on safety measures implemented to ensure a secure environment for students.

Justice Magare emphasized the urgency of a renewed safety inspection, focusing on electrical systems, after reports indicated that previous installations and tests had been done within a single day. This renewed inspection aims to confirm the academy’s adherence to safety protocols. The court allowed the school to reopen specifically for 114 students preparing for the Kenya Primary School Education Assessment (KPSEA), contingent upon the Nyeri County Director of Education, Ms. Jane Njogu, affirming that safety conditions meet required standards.

Attorney Robert Kimunya, representing the school’s Board of Management, confirmed that Hillside Endarasha Academy remains closed for Term Three, apart from KPSEA candidates who will sit for exams from October 28 to 30. He also indicated that further discussions with the Nyeri County Director of Education addressed this arrangement to prioritize safety.
On December 20, Justice Magare will review the case and provide further directions based on the health and safety report findings. This report is essential in ensuring that Hillside Endarasha Academy meets safety standards before any broader reopening.
